Loam is built to answer one question: are the trails rideable right now? These terms explain what Loam is, what it is not, and the rules that apply when you use it.

These Terms of Use ("Terms") govern your use of the Loam mobile application, the Loam website, and related services ("Loam," "the app," "we," "us"). By downloading, accessing, or using Loam, you agree to these Terms. If you do not agree, do not use Loam.

1. What Loam does

Loam provides estimated mountain bike trail conditions based on modeled environmental data, including weather, precipitation, soil characteristics, terrain, and related factors. Loam produces an estimate, not a measurement. It is informational only.

Loam does not inspect trails, does not observe real-time conditions on the ground, and does not know the construction, maintenance state, closures, hazards, or current status of any specific trail. Conditions can change rapidly and can differ significantly from any estimate the app provides.

2. Assumption of risk

Mountain biking is an inherently dangerous activity that can result in serious injury or death. You are solely responsible for your own safety and for every decision you make about whether, when, and where to ride.

Loam is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be accurate, reliable, uninterrupted, or error free.

4. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any injury, death, property damage, trail damage, or any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, Loam, including any reliance on conditions estimates the app provides. This applies regardless of the legal theory and even if we have been advised of the possibility of such damages.

Where liability cannot be excluded by law, our total liability is limited to the amount you paid us, if any, in the twelve months before the event giving rise to the claim.

5. Subscriptions and billing

Loam offers an optional auto-renewable subscription ("Loam Pro"). Subscriptions are billed through the store account you purchase with, either the Apple App Store or Google Play. Payment is charged at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Pricing and subscription terms are shown in the app at the point of purchase.

You manage and cancel subscriptions through your store account settings: on iOS in Settings under your Apple Account, and on Android in the Google Play Store under Payments and subscriptions. Cancelling stops the next renewal. Access continues until the end of the period you have already paid for. Refunds are handled by Apple or Google under their own policies, not by us.

6. Privacy

Loam does not require an account. Our handling of data is described in our Privacy Policy, which is incorporated into these Terms.

7. Changes to these terms

We may update these Terms from time to time. Continued use of the app after changes take effect means you accept the updated Terms. The "last updated" date above reflects the most recent version.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
